The FTC's Endorsement Guides FAQ explains that many people watch without ever seeing the description, so a disclosure there may be missed. It recommends placing it in the video, and its guide for influencers says disclosures made in both audio and video are more likely to be noticed. It also notes that "affiliate link" alone may not be understood; "I earn a commission if you buy through my links" is clearer.
What about YouTube's paid promotion setting?
YouTube Studio has a paid promotion setting: when uploading, under "Paid promotion," you choose "Yes, my video includes branded content," which adds a disclosure label at the start of the video. YouTube's help page on the setting describes it for branded content, sponsorships and endorsements; it does not specifically mention affiliate links, and it says creators remain responsible for their own legal obligations.
The FTC's advice is not to assume a platform's disclosure tool is enough, but to consider using it in addition to your own disclosure. So the practical approach is:
- Always disclose aloud and on screen in the video.
- Always add a plain disclosure line above the links in the description.
- Turn on the paid promotion setting when a brand paid you, sent free products, or otherwise sponsored the video, and consider it whenever a video is built around commissioned recommendations.
In the UK, the ASA expects vloggers to make affiliate content obviously identifiable, for example with an identifier in the title or thumbnail, or on-screen text and a verbal disclosure.
What rules can get a YouTube affiliate channel in trouble?
