The fulfillment method is fine; these practices are not. Each one can lead to fines, account closures or lawsuits.

  • Selling counterfeit or trademark-infringing goods. Copies of branded products, logos or characters can bring takedowns and legal claims.
  • Selling unsafe or uncertified products. In the US, the CPSC requires importers and domestic manufacturers of most children's products to issue a Children's Product Certificate based on tests from a CPSC-accepted third-party lab.
  • Misleading advertising. Claims about what a product does must be truthful and supportable.
  • Fake reviews. The FTC's rule on consumer reviews, which took effect in 2024, prohibits fake reviews, buying positive reviews and suppressing negative ones, and it allows civil penalties for knowing violations.
  • Breaking platform rules. Etsy generally bans dropshipping; eBay forbids buying from another retailer to ship to your buyer; Amazon requires you to be the seller of record.

What consumer rules apply to shipping and refunds?

United States: the FTC Mail Order Rule

The FTC's Mail, Internet or Telephone Order Merchandise Rule requires you to have a reasonable basis for any shipping time you state. If you state none, you must ship within 30 days. If you cannot ship on time, you must tell the customer and offer the choice to accept the delay or cancel for a refund. Refunds for non-credit payments are due within 7 working days.

UK, Canada and Australia
